FSD (Supervised) Usage Notice
FSD (Supervised) is Tesla's Full Self-Driving assistance feature, still classified as SAE Level 2. Legal and liability responsibility rests with the driver, not the vehicle or our company.
Keep both hands near the wheel and eyes on the road at all times
The vehicle monitors driver attention via steering-wheel torque and the interior cabin camera. Repeated inattention first triggers visual/audio warnings, then a strikeout; after 5 strikeouts Tesla suspends FSD. Each strikeout recorded during your rental incurs Supervision Breach Damages of $200 under Section 7 of the agreement, deducted from your deposit.
FSD is not a self-driving taxi
Sleeping, leaving the driver's seat, operating from the back seat, covering the camera, or using weighted devices to trick the steering wheel are strictly prohibited. Any of these will be treated as a serious breach of contract, resulting in immediate vehicle repossession and forfeiture of the full deposit.
Take manual control in special situations
Please disengage FSD and drive manually in tunnels, heavy rain/fog/snow, construction zones without lane markings, private driveways, narrow parking lots, and areas with temporary fire/police direction.
Accident liability
The renter is responsible for all accidents, tickets, scrapes, collisions, or injuries to pedestrians/cyclists that occur while FSD is engaged, handled per the Damage Waiver option chosen and the rental agreement. Our company assumes no joint liability for the FSD software.
Damage Waiver (Optional)
The Damage Waiver is our contractual agreement not to hold you liable for certain damage to the vehicle. It is optional and is not insurance. You may decline it, and your choice never changes your deposit, your vehicle or the terms of the rental (Cal. Civ. Code §§1939.09, 1939.13).
Two options, priced by vehicle
Decline (you carry the risk under Section 9); or Basic, with a $2,500 deductible, at $19/day for Model Y and $29/day for Cybertruck. Charged daily for every day of your rental; rentals of 30 days or more are charged at the monthly rate.
What a plan covers
Above your deductible we absorb: collision damage regardless of fault, including collisions while Autopilot or FSD (Supervised) is engaged; glass, lights, tires and wheels; theft and theft-related vandalism; vandalism unrelated to theft; and the related towing, storage and administrative charges. We never charge any renter for loss of use or diminished value.
When the Waiver does not apply
Only the three statutory categories: intentional or reckless driving, driving under the influence, towing or pushing, or unpaved-road operation; the vehicle being used for commercial hire, a felony, a speed contest or driver training, driven by an unauthorized driver, or taken outside the United States; or fraudulent information. Cleaning, recharging and key-card replacement are service fees that do not affect the Waiver, and a late accident report does not void it.
Your own insurance may already cover this
Your own auto policy or the credit card you pay with may already provide all or part of this protection, so a Waiver may duplicate it. Check your coverage and deductible with your insurer or card issuer before booking. We disclose this again in writing at signing and ask for your initials.
Payment and Refund Policy
All orders must be paid online to lock in a vehicle. The refundable vehicle deposit is a flat $1000, regardless of rental length, and is paid in full together with the order unless you choose the reservation-deposit option below. Credit/debit cards and WeChat Pay are accepted. The following terms take effect upon order confirmation.
Deposit is not a liability cap
The deposit is security for amounts you owe under this Agreement; it is not a limit on your liability and does not cap any amount owed under Sections 7, 9 or 10. Where the amounts properly owed under this Agreement exceed the deposit we hold, the deposit is applied first and the remaining balance is due within 30 days of the notice described above. We will not charge any payment method for a balance above the deposit without your separate written authorization.
Reservation deposit (only if selected)
Only when you choose the "pay deposit to lock the vehicle" option: the reservation deposit is the greater of 20% of the base rental charge or one day's base rental charge (base rental only, excluding taxes, fees and add-ons). The reservation deposit is non-refundable. It is applied toward the rental charge. The remaining balance (total charges including tax and add-ons, minus the reservation deposit) and the refundable $1,000 vehicle deposit are due together before the pickup start time. Reservations starting within 24 hours of booking must be paid in full. The vehicle deposit remains flat and refundable at $1,000, and the Damage Waiver remains optional.
Reservation-deposit cancellations
Only when you choose the "pay deposit to lock the vehicle" option, the reservation deposit is non-refundable and is applied toward the rental charge. If the balance is not paid by the pickup start time, the reservation is automatically cancelled, the vehicle is released, and the reservation deposit is kept. If we cancel for our own reasons, we will contact you to resolve the reservation deposit case by case; no automatic refund or non-refund is promised in this case.
Cancellations and changes by you
Once paid, the order amount is non-refundable (including force-majeure cancellations). Orders can be changed once for free (vehicle / rental dates) if more than 10 days before pickup; no changes within 10 days of pickup. Any refund or rent reduction we agree to is returned to your original payment method in the agreed amount.
WeChat Pay refund window
Payments made with WeChat Pay can only be refunded to the original method within 180 days of payment.
No-shows are treated as order forfeiture
If you do not arrive within 2 hours of your scheduled time without prior notice, the order is automatically treated as forfeited, the vehicle is relisted, and payments already made are non-refundable.
Early returns are not refunded
Once the rental has begun, the full order duration is charged; unused days from an early return are not refunded. The deposit is refunded via the original payment method based on the return inspection, and is not prorated for an early return.
Cancellations caused by us (reservation deposits: see below)
Except for reservation deposits, which are resolved case by case as described below, if the vehicle cannot be delivered due to mechanical failure, recall, or an accident and no replacement is available, we will fully refund all payments made and provide a voucher equal to 10% of the order amount.
Deposit refund
With no violations or damage, our team refunds the deposit to your original payment method after a passed return inspection; any tickets, tolls, or damage are deducted first. Actual credit card posting time depends on your card issuer (typically 3–7 business days). Payments made with WeChat Pay can only be refunded to the original method within 180 days of payment.
Rental Agreement Key Points
At pickup you'll sign a bilingual Chinese/English e-contract (RENTALFSD Vehicle Rental Agreement · v1.8). Below is a summary of the most-asked clauses; the signed version is the final authority.
Prohibited uses
Strictly prohibited for any commercial use such as Uber, Lyft, DoorDash, or Instacart; off-roading, track driving, towing, driving instruction, and illegal transport are also prohibited. Violations result in immediate vehicle repossession, forfeiture of the full deposit, and potential legal action.
Permitted driving area
You may drive anywhere within the United States. Driving into Mexico or Canada is prohibited.
Mileage policy
150 miles per rental day, accumulated over the rental period. Excess mileage is $1.00/mi for Model Y and $1.20-1.50/mi for Cybertruck depending on trim. The odometer is read automatically at pickup and return: excess miles = (return odometer − pickup odometer) − included free miles, and the charge = excess miles × the rate. The breakdown appears on your order page and e-contract; it is never charged separately to your card and is deducted from your deposit during the manual review.
Late return
Late return: 1-hour grace period; after that, 1/4 of the daily rate per started hour, capped at one day's rate per 24 hours, plus sales tax. No late penalty. The vehicle's standard daily rate applies, and the charge is deducted from your deposit.
Charging and return battery level
Supercharging used during your rental is deducted from your deposit at Tesla's actual invoiced cost (waived with the Unlimited Supercharging package). The battery level at return must be at least the pickup level minus 10%; otherwise we charge the energy needed to restore the pickup level at $0.60/kWh plus a $25 charging service fee (waived with the Unlimited Supercharging package). The charge limit is set to 80%; please do not raise it — the system resets it to 80% automatically.
Tickets and toll fees
The renter is responsible for all traffic tickets, parking tickets, and toll fees incurred during the rental; they are deducted from your deposit at cost, plus a $25 processing fee per rental when we handle tolls on your behalf (no tolls or fee with the Free Toll Road package). Each ticket carries a $50 processing fee; speeding, red-light and stop-sign tickets carry an extra $200 handling fee ($250 per ticket in total), plus the original fine in every case. Excessive soiling, odor or pet hair is charged a $100 cleaning fee.
Renter Age Requirement
Renters must be at least 21 years old on the pickup date; renters under 21 are not accepted.
Minimum age 21
Renters must be at least 21 years old. Both a valid ID and the original license are required.
Minimum age
Renters must be at least 21 on the pickup date; there is no young-driver surcharge. The Damage Waiver is always optional — we will not refuse the rental, change the vehicle, or raise your deposit because you decline it (Cal. Civ. Code §1939.13).
Deposit does not vary by age
The deposit is a flat $1000, regardless of rental length and the same for renters of every age; we never raise the deposit or add fees because of age.
No additional drivers allowed
Every vehicle may only be driven by the renter — additional drivers are not accepted (neither free nor paid). If anyone else drives, it is a breach, the Damage Waiver does not apply and the renter bears all losses.
Notice for Non-U.S. (Foreign) License Holders
Non-U.S. residents may drive in California with a valid foreign (non-U.S.) license. We rent directly to foreign license holders — please prepare the following.
All three documents are required
① Original foreign driver's license (valid, not a learner's permit) ② For non-English licenses, an official English translation or an International Driving Permit (IDP), presented together with the original ③ Valid passport with U.S. entry stamp / I-94.
May drive directly within 10 days of entry
Under California CVC §12502, non-residents may drive with their foreign license within 10 days of entry. Beyond 10 days without a California license, we are unable to rent to you — please plan ahead or apply for an International Driving Permit (IDP).
IDP is not required but strongly recommended
An International Driving Permit (IDP) has no standalone validity and must be used alongside your home-country license. It greatly eases communication for insurance claims or police checks — we recommend obtaining one before your trip.
Damage Waiver and claims
Renters with a foreign license may choose any Damage Waiver option (including none), with claims handled under California law. In the event of an accident, we assist with Chinese/English translation, filing a police report, towing, and repair coordination, though liability remains with the driver.
License information verification
At pickup, our staff will photograph the original license (and any translation or IDP) for records, and verify that the name matches the order and passport. If there is a mismatch, additional ID must be provided on the spot, or the vehicle cannot be released.
Delivery and Collection (Paid Services)
Store pickup and return in Irvine is always free. If coming to the store is inconvenient, you can add Delivery and Collection on the booking page — two separate paid services that can be chosen individually or together.
Service area: within 100 miles of the store
This covers Orange County, Los Angeles, northern San Diego, Riverside and western San Bernardino. Enter the ZIP code of your address on the booking page and the system tells you immediately whether it is in range. ZIP codes outside the area cannot book doorstep service online — please use store pickup and return, or contact customer service on WeChat.
Pricing: tiered by one-way distance, one flat fee per leg
The fee is tiered by the one-way road distance between your address and the store: $50 up to 10 miles, $80 up to 20 miles, $100 up to 30 miles, $130 up to 60 miles, and $2.50 per mile of the one-way distance beyond 60 miles. Delivery and collection count as one leg each, so choosing both means two charges. The amount is shown live on the booking page, is included in the order subtotal, and is subject to the usual 7.75% sales tax. The price you see at booking is the price you pay.
How the distance is determined
We price by the approximate road distance from your address's ZIP code to the store, applying the same distance to every address within a ZIP code. The benefit is that the price is fixed at the moment you book and never changes because of the actual route, traffic or detours. If you believe a ZIP code's distance is clearly wrong, contact customer service on WeChat and we will verify and adjust it.
Delivery and collection can be two addresses
You can enter a delivery address and a separate return address when booking (for example, delivery to a hotel and collection at the airport). Each leg is priced on its own ZIP-code distance to the store using the same tiers. If both ends are the same, just tick “Return address is the same as the delivery address”.
Documents are still verified in person at handover
Doorstep service only changes where the handover happens — the process is the same. The renter must be present in person, present their original license (plus the original passport for a non-U.S. license) for verification, and complete the vehicle inspection face to face. If no one is present at the agreed time or the documents cannot be verified, the vehicle cannot be released and the doorstep fee already paid is not refunded.
Full Rental Agreement · v1.8
1 · Definitions and the Agreement
"We" means RENTALFSD LLC, a California limited liability company. "You" means the renter who signs the Rental Summary.
This Agreement consists of the Rental Summary, these Terms and Conditions, the Vehicle Condition Report (Exhibit A) and the Fee Schedule (Exhibit B).
"Authorized driver" means you, your licensed spouse who meets our minimum age, and any person listed on the Rental Summary.
2 · Rental Period, Return, Extension and Substitution
The rental period runs from vehicle handover at our store until you return the vehicle and check-in is complete. Late returns are charged per the Fee Schedule.
To extend, contact us before the due-back time. Extensions depend on availability and continue at the same rates, including any Damage Waiver.
If your specific model is unavailable we may provide the same or a higher class; if we cannot, you may cancel for a full refund; if you chose the reservation-deposit option, the reservation deposit is resolved case by case under Section 17.
3 · Driver Requirements
The renter must hold a valid licence and meet our minimum age. The same rules apply to every foreign (non-U.S.) licence: present the original licence (valid, not a learner's permit) and a valid passport with U.S. entry record / I-94; non-English licences must also be accompanied by an official English translation or an International Driving Permit (IDP); digital licences or screenshots are not accepted.
Only the renter may drive the vehicle. We do not accept any additional drivers, whether free or paid.
Driving by anyone other than the renter is a breach and voids the Damage Waiver (Section 10).
4 · Charges, Deposit and Payment
Rental, optional products, taxes and the vehicle deposit are charged as shown in Section D of the Rental Summary; Orange County (Irvine) sales tax is 7.75%. Unless you choose the "pay deposit to lock the vehicle" option described below, the full order amount, including the deposit, is paid online in one payment. Credit/debit cards and WeChat Pay are accepted.
The vehicle deposit is a flat $1000, regardless of rental length, the same for every renter of the same vehicle class, regardless of whether you buy the Damage Waiver or any optional product (§1939.13(b)); it is refunded to your original payment method after a passed return inspection, with any tickets, tolls, or damage deducted first. Payments made with WeChat Pay can only be refunded to the original method within 180 days of payment.
Before charging you for damage, we will give you the repair estimate or invoice, photographs and a description of the loss, and at least 10 days from that notice to dispute it in writing.
5 · Vehicle Condition and Cleaning
Inspect the vehicle with us at pickup and confirm the Vehicle Condition Report (Exhibit A); we check it in against the same report on return.
Return the vehicle as clean as you received it. Excessive soiling, smoke odour or pet hair is charged as a cleaning service fee per the Fee Schedule — a service fee, not vehicle damage, and it does not affect the Damage Waiver.
6 · Electric Vehicle and Tesla Specifics
Return the vehicle at the state of charge agreed in the Rental Summary; a recharging service fee applies per the Fee Schedule if you do not.
Supercharging and third-party charging during your rental are your cost; amounts we are billed are passed through at cost.
Follow the charging guidance provided with the vehicle. Loss caused by not following it is handled under Section 9, which covers collision damage only.
Key cards, charging cables and adapters are vehicle equipment: loss or damage is charged as a replacement fee under the Fee Schedule, not as vehicle damage.
Charge Limit: the vehicle's charge limit is set to 80%. Do not raise it; the system resets it to 80% automatically.
7 · Autopilot and FSD (Supervised)
Autopilot and FSD (Supervised) are driver-assistance features, not self-driving. Keep your hands on the wheel, watch the road, and be ready to take over at all times.
You remain fully responsible for the operation of the vehicle at all times, including while these features are engaged.
Do not use any device that defeats the steering-wheel or attention monitoring.
Supervision Breach Damages: the vehicle monitors driver attention through steering-wheel torque and the cabin camera. Each Autopilot / FSD strikeout recorded by Tesla during your rental constitutes a breach of your duty to supervise the vehicle at all times, for which you will pay damages of $200. This amount may be deducted from your deposit.
A collision that occurs while driver-assistance features are engaged falls under Section 9 and is covered by any Damage Waiver you purchase (Section 10).
8 · Prohibited Uses
You must not: use the vehicle for commercial hire such as rideshare or delivery; enter a speed test, contest or driver training; tow or push anything; drive on unpaved roads; let an unauthorized driver drive; drive under the influence of alcohol or drugs; use it in connection with conduct chargeable as a felony; smoke in it; or drive outside the permitted area — and never outside the United States.
Breach of this Section is a breach of contract: we may repossess the vehicle and charge the applicable service fees. Only the circumstances listed in Section 10.5 make the Damage Waiver inapplicable.
9 · Responsibility for Damage
To the extent permitted by §1939.03 and §1939.05, and subject to any Damage Waiver you buy, you are responsible for: (a) collision damage regardless of cause, up to fair market value; (b) theft, only if we establish by clear and convincing evidence that you or an authorized driver failed to exercise ordinary care; (c) vandalism connected with theft, under the same rule; (d) vandalism unrelated to theft, up to $500; (e) actual towing, storage and impound charges we pay; and (f) an administrative charge.
Theft safe harbour: if an authorized driver returns the key card, reports the theft to police within 24 hours of learning of it and reasonably cooperates, you have no liability for the theft.
Administrative charge, by statute: none if the estimate is $100 or less; $50 for $100.01–500; $100 for $500.01–1,500; $150 above $1,500.
Repair cost is capped at the estimated parts and labour at the rates we customarily pay, with all discounts passed to you. You are not responsible for loss of use, diminished value, or damage that does not result from collision (such as weather, fire, mechanical or battery failure).
You may require us to submit the claim to your own personal or business auto insurer, and we will not collect from you any amount we recover from another person or insurer.
10 · Damage Waiver (Optional)
10.1 Nature: the Damage Waiver is our contractual agreement not to hold you liable for certain damage to the vehicle. It is optional and is not insurance. You may decline it. We do not condition the rental, the vehicle offered, or the deposit amount on whether you buy it.
10.2 Plan and charges: the deductible is the most you pay for covered loss per rental (per 30 days for rentals of 30 days or more) and includes any administrative charge. Basic $2,500 deductible (Model Y $19/day, Cybertruck $29/day). Daily charges apply to each full or partial 24-hour day, for every day of the rental; rentals of 30 days or more are charged at the monthly rate (Model Y $270, Cybertruck $410).
10.3 Covered loss: above the deductible we will not hold you responsible for collision damage regardless of cause, including collisions while Autopilot or FSD (Supervised) is engaged; damage to glass, lights, tires and wheels; theft and vandalism connected with theft; vandalism unrelated to theft; and towing, storage, impound and administrative charges incident to those.
10.4 You never pay more than the law allows: with a plan, your responsibility for any loss will not exceed what you would owe for it under Section 9 without the Waiver; where that is lower than your deductible, the lower amount applies.
10.5 When the Waiver does not apply (§1939.09(b) — these are the only circumstances): (a) loss results from an authorized driver's intentional, willful, wanton or reckless conduct, driving under the influence in violation of Vehicle Code §23152, towing or pushing anything, or operation on an unpaved road where the loss is a direct result of the road or driving conditions; (b) the vehicle is used for commercial hire, used in connection with conduct chargeable as a felony, in a speed test or contest or driver training, operated by a person other than an authorized driver, or operated outside the United States; or (c) an authorized driver provided fraudulent information, or false information without which we would not have rented.
10.6 Accident reporting and cooperation are contractual duties, not conditions of the Waiver: failing to report within 24 hours, to call the police or to cooperate does not void the Waiver, but you are responsible for loss we can show resulted from that failure.
10.7 Acknowledgement: your initials on the signing page confirm we disclosed that the Waiver is optional and may duplicate coverage under your own motor vehicle insurance policy.
10.8 Paying your deductible. The deductible in Section 10.2 is payable by you and is not capped by the vehicle deposit. If it exceeds the deposit we hold, the balance is payable as provided in Section 4. Nothing in this Section enlarges your responsibility beyond what Sections 9 and 10.4 and California law permit.
11 · Liability Protection
We maintain the minimum third-party liability protection required by California law. It responds to third-party bodily injury and property damage at statutory minimum limits and does not cover damage to the vehicle itself.
If you are not a U.S. resident, you appoint us as your agent for service of process in California for actions arising out of this rental (§1939.33).
12 · Accidents and Roadside Assistance
After an accident, theft or vandalism: once safe, notify us within 24 hours; where there is injury, a third party or theft, report to the police and obtain a report number.
Do not admit fault to or settle with any third party. Give us the other parties' details, photographs and a written statement, and cooperate with us and our insurer in recovering from anyone responsible.
Tesla vehicles must be transported on a flatbed.
13 · Tolls, Citations and Administrative Fees
Tolls, parking and traffic citations and related administrative fees incurred during your rental are your responsibility; we pass them through at cost once billed, plus the processing fee in the Fee Schedule.
14 · Personal Property
We are not responsible for loss of or damage to personal property left in or on the vehicle.
15 · Connected-Vehicle Data and Privacy
Under §1939.23 we use vehicle telematics or location data only to recover a stolen, overdue or unaccounted-for vehicle (following the statutory notice procedure), to respond to a subpoena or court order, and to confirm whether the vehicle left the agreed geographic area.
We do not use this data to track your everyday driving or to charge you penalties. Dashcam and Sentry Mode footage is subject to the same limits.
In ordinary operation we read pickup and return times, mileage and state of charge.
16 · Indemnity and Limitation of Liability
We warrant that the vehicle delivered to you is safe and roadworthy; to the extent permitted by law we make no other express or implied warranty.
To the extent permitted by law neither party is liable for indirect, incidental or consequential damages. Nothing here limits liability that cannot be limited by law.
17 · Cancellation and Refunds
Cancellations and refunds follow our published Cancellation and Refund Policy (the "Payment and Refund Policy" section of our Rental Notice page). Damage Waiver charges are refunded on the same basis as the rental charge and are not withheld separately. Refunds go to the original payment method; payments made with WeChat Pay can only be refunded to the original method within 180 days of payment.
18 · Dispute Resolution and Arbitration
This Agreement is governed by California law. Disputes are first discussed in good faith; if unresolved, they go to individual arbitration before the AAA under its Consumer Arbitration Rules in Orange County, with a class-action waiver.
You may opt out of arbitration in writing within 30 days of signing. Nothing here limits either party's right to bring a small-claims action or to seek public injunctive relief. We pay the AAA's arbitration fees.
19 · General
This Agreement is the entire agreement between us for this rental; changes must be in writing.
If any provision is held invalid, the rest remains in effect.
Force majeure: neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
A Chinese translation of this Agreement was provided to you before signing, as required by §1632.
Marketing texts and emails require your separate opt-in and you may reply STOP at any time; this is unrelated to the rental itself.
The renter confirms full understanding that FSD (Supervised) is a driver-assistance feature, that they remain fully responsible for the vehicle's safe operation at all times, and that they accept all legal, liability, and insurance consequences from using FSD. If these notices conflict with the final signed RENTALFSD e-contract, the e-contract governs.
